Information Obligation – Job Candidates / Collaborators

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), we hereby inform you that:

Providing personal data as specified in Article 221 of the Polish Labour Code is necessary to participate in the recruitment process(es). The provision of other personal data is voluntary.

 

 

The legal grounds for processing the personal data of job candidates/collaborators are:

 

a) The processing is necessary to take steps at the request of the data subject (the candidate) prior to entering into a contract (GDPR, Article 6(1)(b)).

 

b) For job candidates: The processing is necessary to comply with a legal obligation incumbent on the Data Controller (Article 22 of the Polish Labour Code; GDPR, Article 6(1)(c)).

 

c) The data subject has given consent to the processing of their personal data for one or more specific purposes (GDPR, Article 6(1)(a), or Article 9(1)(a) where applicable).

 

d) The processing is necessary for the purposes of legitimate interests pursued by the Data Controller or its Clients (GDPR, Article 6(1)(f)), such as ensuring the security of financial resources handled by employees/collaborators as part of their professional duties.

 

 

Personal data is processed to conduct one or more recruitment processes, including the evaluation and selection of the most suitable candidate for a specific position or collaboration with the Company.

 

 

Personal data is accessible only to authorized employees of the Company involved in the recruitment process. Appropriate safeguards have been implemented and are maintained to ensure the security of the data.

 

 

Candidates’ personal data will not be transferred to other data recipients, including international organizations or recipients in third countries.

 

 

Personal data will be processed until consent is withdrawn or:

 

7.1. Until the end of the specific recruitment process if consent was granted solely for that process.

 

7.2. Until the end of the calendar year following the year in which the application was submitted, if consent was granted for multiple recruitment processes, including those initiated after the submission of the application.

 

 

In connection with the processing of personal data, data subjects have the following rights at any stage of data processing:

 

(i) The right to access their data and information about the purpose and scope of its processing.

 

(ii) The right to rectify data, restrict its processing, and transfer it.

 

(iii) The right to delete data (“the right to be forgotten”) and object to the processing of personal data, provided there are no overriding legitimate grounds for processing that prevail over the data subject’s interests, rights, and freedoms.

 

(iv) The right to withdraw consent at any time, with the understanding that withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.

 

(v) The right to lodge a complaint with a supervisory authority for data protection (in Poland, the Personal Data Protection Office).
